The Council of the European Union has issued a corrigendum to the EU-Norway Passenger Name Record (PNR) Agreement, correcting two cross-references from "Annex I" to "the Annex" in all language versions. The correction, published on 24 June 2026, addresses errors in Article 2, point (5) and Article 3(3) of the agreement, which was signed in Luxembourg on 14 October 2025.
The corrigendum, classified as a correction of obvious errors under Procedure 2(c), amends the definition of PNR data in Article 2(5) to state that the data elements are exhaustively listed in "the Annex" rather than "Annex I." Similarly, Article 3(3) now requires Norway's Passenger Information Unit (PIU) to delete any data element received from an air carrier that is not listed in "the Annex," correcting the earlier erroneous reference. Member states have three days to submit observations on the corrigendum to the Council's Directorate for Quality of Legislation.
This is a purely technical correction that does not alter the substantive obligations of the agreement. The EU-Norway PNR Agreement, signed on 14 October 2025, aims to facilitate the transfer of PNR data for the prevention, detection, investigation, and prosecution of terrorist offences and serious crime. The corrigendum ensures legal clarity and consistency across all language versions, but the core provisions on data protection, retention periods, and oversight mechanisms remain unchanged. The correction has no direct impact on stakeholders such as air carriers, data protection authorities, or law enforcement agencies, as it merely rectifies a drafting error without modifying the agreement's scope or requirements.
