A Commission Staff Working Document published on 23 July 2026 evaluates Luxembourg's implementation of the Nitrates Directive for the 2020–2023 period, finding progress in groundwater quality but persistent challenges from high livestock density and surface water eutrophication. The document, based on Luxembourg's national report and EU data, assesses the effectiveness of the country's action programme, which applies to the entire territory designated as a Nitrate Vulnerable Zone since 1994.

Luxembourg's action programme, based on the Règlement grand-ducal of 2000 and subsequent amendments, includes restrictions on fertiliser application periods, buffer zones near watercourses, storage capacity requirements, and balanced fertilisation. No modifications to general legislation occurred during 2020–2023, though stricter measures for Lake Haute-Sûre protection zones were adopted in 2021. Monitoring networks for groundwater and surface water saw density decreases, and no lake monitoring was conducted. Controls are carried out by the Water Management Administration and through CAP conditionality inspections. During the period, 78 pollution incidents of agricultural origin were identified.

11.8% of monitoring points exceeded the 50 mg/l nitrate limit, down from 25% in the previous reporting period, and 35.2% of points showed decreasing trends. Surface water fared better regarding nitrate, with no points exceeding 50 mg/l, but eutrophication remains a concern: 85.7% of river monitoring points are eutrophic or at risk, a slight improvement from 100% in the prior period. High livestock density (1.18 livestock units per hectare) and agricultural pressure persist, and nutrient balance data gaps remain.

The Commission recommends reinforcing measures to improve surface water quality, enhancing monitoring representativeness (especially for lakes), closing data gaps, and better aligning the action programme with the Water Framework Directive. Luxembourg is developing the LuxZPS platform to evaluate measures and forecast water quality trends. The findings will inform future revisions of the national action programme and EU-level policy discussions on water protection from agricultural nitrate pollution.
