MEP Fabio De Masi (NI) has asked the Council of the European Union to assess the international law implications of NASA's plan to establish a permanent base on the Moon and demarcate territory using drones. In a parliamentary question submitted on 6 June 2026, De Masi raises concerns over potential violations of the Moon Agreement and the Outer Space Treaty, which prohibit national appropriation of celestial bodies and require their use for peaceful purposes. The MEP also inquires whether the Council plans to take measures to prevent the militarisation of space and the unilateral appropriation of space resources, and whether it considers existing multilateral agreements sufficient or supports updating them. The question reflects growing unease among some EU lawmakers about the rapid expansion of space activities by non-EU actors and the adequacy of current legal frameworks. The Council is expected to respond within approximately six weeks, and its answer will signal the EU's stance on space governance and its willingness to pursue new international mechanisms.
