A European Commission staff working document published on 23 July 2026 evaluates Estonia's implementation of the Nitrates Directive (91/676/EEC) for the 2020–2023 period, finding rising nitrate concentrations in groundwater and widespread eutrophication, and recommends reinforcing mitigation measures, reviewing nitrate vulnerable zone (NVZ) designations, and improving data reporting.

The document, based on Estonia's national report, Eurostat data, and other official sources, assesses agricultural pressures, water quality, NVZs, and the action programme. Estonia modified its action programme with faster mandatory incorporation of manure into fields (1–30 November), extended manure storage requirements, and limited temporary solid manure storage, while repealing mandatory spreading plans for liquid manure for holdings with ≥400 livestock units. NVZs cover 13.5% of utilized agricultural area and have remained unchanged since 2003; a study on amending NVZ borders was commissioned in 2023.

Water quality indicators show deterioration. Groundwater monitoring (8.1 stations per 1,000 km²) found 7.1% of points with nitrate concentrations ≥50 mg/l, up from 3.0% in the previous reporting period, and 24.6% of points show increasing trends. Surface water nitrate levels are lower (0.3% of points ≥50 mg/l), but 47.3% of surface water monitoring points are eutrophic or could become eutrophic. Eutrophication hotspots are concentrated outside NVZs: 92.3% of eutrophic points lie outside designated zones, and 26.2% of groundwater nitrate hotspots are outside NVZs, suggesting current designations may be insufficient. Estonia reports nitrogen losses from agriculture increased from 54.7 to 58.4 kilotonnes between reporting periods.

The Commission recommends reinforcing measures to address rising nitrate levels, reviewing NVZ designations, closing data gaps on nutrient balances (no nitrogen and phosphorus balance data reported since 2013), and improving cooperation and climate resilience. Climate change, with warmer winters and increased rainfall, is expected to exacerbate nitrate leaching, requiring adaptive management in action programmes. The findings also have implications for compliance with the Water Framework Directive, as eutrophication in lakes (71.9% eutrophic or could become, up from 57.5%) and coastal/marine waters (100% eutrophic) poses risks to aquatic ecosystems.

Estonian farmers face potential new compliance costs if NVZ boundaries are expanded or action programme measures tightened, particularly those outside current NVZs who may be newly regulated. National authorities will need to invest in monitoring infrastructure and data collection to close reporting gaps. Environmental NGOs may welcome stronger measures but push for faster action. EU institutions, including the Commission and the European Parliament, will monitor follow-up; the Commission may initiate infringement proceedings if Estonia fails to address shortcomings.
