On 13 July 2026, the Council of the European Union formally adopted a legislative act amending Regulation (EC) No 261/2004 on air passenger rights and Regulation (EC) No 2027/97 on air carrier liability. The act updates rules on compensation and assistance for passengers in cases of denied boarding, cancellation, or long delay of flights, as well as carrier liability for passengers and their baggage. The adoption follows approval by Coreper, Part 1, on 8 July 2026.

The revised regulation applies to all air passengers and carriers operating in the EU. Key changes include updated compensation amounts, clearer definitions of extraordinary circumstances that exempt carriers from liability, and streamlined procedures for claims. The amendments aim to strengthen passenger protections while balancing operational burdens on airlines. The act will enter into force 20 days after publication in the Official Journal of the European Union, with member states required to transpose certain provisions into national law within a specified period.

Air passengers will benefit from enhanced compensation and clearer rights, particularly in cases of long delays. Airlines face increased compliance costs and potential liability adjustments, though the clarification of extraordinary circumstances may reduce litigation. National enforcement bodies will need to update oversight mechanisms. Consumer groups have welcomed the stronger protections, while industry representatives have raised concerns about operational costs and potential impacts on ticket prices.

The European Commission will oversee implementation and may issue guidelines. The European Parliament, which co-decided on the text, will monitor transposition. The Council's adoption finalises the legislative process, with the formal signature by the Council and Parliament expected shortly.
