MEP Per Clausen (The Left) has asked the European Commission what specific measures it will take to ensure Denmark complies with the Enforcement Directive on the Posting of Workers regarding joint and several liability. The question, submitted on 15 July 2026, follows a European Labour Authority (ELA) report in 2025 on posted workers' rights and a 2026 coordinated inspection campaign across 18 countries that found widespread violations. Clausen also references the European Parliament's February 2026 report on subcontracting chains, which called on the Commission to enforce existing EU law and initiate infringement proceedings where necessary.
The question targets Denmark's implementation of joint and several liability, a mechanism that holds contractors responsible for subcontractors' compliance with posted workers' pay and conditions. The Enforcement Directive (2014/67/EU) requires Member States to ensure such liability, but Denmark's rules have been criticised as insufficient. Clausen, a Danish MEP from The Left group, is pushing the Commission to act on Parliament's call for enforcement.
The Commission is expected to reply within six weeks. Its answer will signal whether it views Denmark's measures as compliant or if it plans further action, such as infringement proceedings.
