- “Thank you. Mr. Chair. I'll also be brief. Um, the commission, uh, reserves this position, but I will refer briefly to just to scope climate plan and the suspension of business relations on the scope. Of course, as you know, the omnibus proposal did not touch the thresholds. The aim is to preserve and the simplification objectives deliver burden relief to companies, while maintaining also the Directive's original aims. Of course, raising the thresholds reduces the burden on the companies that will no longer be covered, but equally it will reduce the impact of the directive regarding the climate plan. The omnibus proposal is not about weakening the climate plan or its implementation, but rather aligning the behavioural duty enshrined in the CSS triple D with the reporting duty in CC'd. And in our view, the deletion of the plan goes goes too far and the CSD or triple the obligation is not a duplication of the CC'd. These two directives are complementary. As announced in the Clean Industrial Deal, the Commission is working on methodologies, including sectoral pathways to help companies develop their climate plans. And furthermore, we also have concerns with regard to jurisprudence of the European Court on Human Rights when it comes to possibly removing the plan altogether as regards the suspension of business relationships, the proposal to exempt the company from the obligation to suspend as a last resort, in case such suspension would cause substantial prejudice to the company. We are concerned this might create a tension, actually, with national civil liability regimes, and also with the recognition of the primacy of human rights over economic interests in national, EU and international law. - “Good morning. Many thanks, Mr. Chair, for the opportunity to to be part of this interesting workshop. We are, of course, interested to follow very closely your deliberations in view of the own initiative, legislative report of the Parliament, and certainly, uh, since the timelines for the development of the Commission proposal and, uh, your timeline for, for the own initiative legislative report are largely overlapping. Uh, we are interested to follow this closely to ensure as much convergence as possible so that whatever, uh, comes, uh, from your report can, can be taken into account, uh, when when we prepare the proposal of the commission, which, as you know, is due for the first quarter of next year. Um, so in terms of process, uh, I would like just to draw your attention to the fact that very soon we expect to launch a call for evidence and open public consultation on the future initiative. Uh, we are also, uh, engaged in structured consultations with stakeholders, including in the form of a high level forum on justice for growth, where member states, but also the business community and other stakeholders are. The Parliament is also taking part in that forum. And in parallel, we we are also receiving input from, uh, from stakeholders. Um. In, in substance, what has been discussed is of course, uh, very interesting and an inspiration for us, actually. You will see many of the points will, will will appear in this open public consultation.”

- “And that's the main purpose, um, and to to improve competitiveness in Europe, to make it easier to set up companies to grow, to attract investment. But it also has to balance this with interests of other stakeholders. Of trade unions, of investors and others. So this is why this we are consulting widely. And we are aiming for for a balanced and realistic solution. Also we have to build on recent advances. And it was mentioned that indeed, in recent years there has been considerable progress in incremental harmonisation in company law, with two digitalisation directives. The most recent one just entered into force earlier this year. So these and one on cross-border mobility, there are, uh, let's say advances there in terms of harmonisation, also safeguards against, uh, you know, to, to guarantee, um, that there is no abuse. Uh, and uh, you know, some, of the, some of the possible pitfalls that that were mentioned. So we uh, in a nutshell, um, much of what we heard today is, is really at the at the core of our agenda. There is a lot of, um, I would say, um, synergy between, uh, this process here in Parliament towards the own, uh, legislative own initiative, legislative report and the work on the commission's proposal. And we look forward to to continuing this conversation as we advance, uh, with the two processes. Thank you very much.”

- “These these are also exactly the topics that that are on our agenda. Um, obviously it was mentioned there are challenges and legal limitations, uh, in terms of what we can what can be done at EU level. Um, and our approach, the commissioner's approach, um, Commissioner McGrath, is to be ambitious, uh, to make a difference for, for companies and for competitiveness, but also realistic. And, uh, I would like to refer to, to the policy documents that are framing this, this 28th regime, uh, indeed, with ambition touching, uh, a number of policy areas. And this was expressed in the Competitiveness Compass, among others. But also just recently, two um, strategies came out, Mode adopted by the Commission. One on the single market and one on start ups and scale ups. And for instance, I will draw your attention to the fact that the single market strategy mentions that the 28 regime could possibly be delivered in the progressive and modular way. So this very much resonates with some of the comments that were made by by the presenters. Uh, we are also, um, basing ourselves on the lessons learned from the past, and it's very, very good to see that these are also, uh, let's say, in the background of, uh, of your deliberations. Uh, obviously, the solution that we will be proposing has to balance a number of interests. Uh, it has to help companies.”

- “Thank you very much, Mr. Chair. Mr. rapporteur. Uh, honourable members, I'll be very short. It's we are really very glad to to see the advancement of the work on the parliament's report on the 20th regime. Both the Commission, the Commission and the Parliament have committed to a tight timeline, uh, on the 20th regime. So the commission plans to to adopt the proposal by the first quarter of next year. And we have already launched last week the call for evidence and open public consultation. So we see many points of of convergence in the draft report of Mr.. And we look forward to following closely the work on this again tight timelines. We welcome in particular the focus on on corporate law, which is also the focus of Commissioner McGrath. And just to to say that indeed, the 20th regime was pledged to cover or to touch a number of policy areas, including labour, low taxation. But in the single market strategy, it was also clarified that it might be delivered through a modular and progressive approach, and it will include a corporate legal framework. And this is where indeed Commissioner McGrath is focusing. However, other areas we are also covering in, in, in the open public consultation and it will be for the Commission then to, to decide how to take those forward. So we very much look forward to working with you in this joint endeavour to deliver something that makes a difference for our entrepreneurs and the start up and scale up community. Thank you.”

- “Many thanks, Mr. Chair. Um, I will keep it short because, as you know, the processes for the commission proposal, which is under preparation and this own initiative report of the Parliament are running in parallel. Therefore, we we are following closely. Um, but this is also the reason why I am not in a position, uh, at this stage to, to, uh, make pronouncements about the future proposal. Uh, what I can, uh, tell you in terms of, uh, update on the process is that we, uh, Recently closed at the end of September. The call for evidence and the open public consultation, with the significant number of replies showing the high interest for this initiative. We had 1470 replies to the Open Public Consultation. 879 to the call for evidence. More than 100 position papers submitted. We are now analysing all these. The open public consultation included, uh, questions, quite detailed questions on the corporate legal framework, the issues that that were mentioned as well, but also on other issues related to taxation, labour insolvency and cost of failure. Uh, we are currently analysing this input and, uh, decisions, uh, on the content of the of the exact content of this proposal will be made soon. Um, it's difficult to say more until that time, but we will certainly stay in touch, uh, with the team of, uh, the rapporteur and will follow very closely these developments and hopefully very soon we will be able to also share more on our side.
